is medical marijuana legal in floridaIs medical marijuana legal in Florida?  Not just yet, but advocates are hoping to make a deal to change that.  A recent proposal, termed a “negotiated rule-making,” was discussed by a 12-person panel during a 14-hour meeting regarding distribution of non-euphoric medical marijuana to authorized medical patients in the state by growers.

After Florida’s November poll results only reeled in 57% of voters in favor of amending the constitution for medical marijuana (which was just short of the required 60% minimum in order to make the amendment), this new proposal allows a rare second chance to discuss legalizing medical marijuana in the state.  “Here’s the deal,” began to explain Patricia Nelson, who is director of the Florida Department of Health’s Office of Compassionate Use.  “We’re very cognizant of the fact that we need to have dispensing facilities.  We still think that sprawl of these types of facilities is not a good thing.”  Assuming all goes well with legislature, Nelson believes that growers will have the capability to grow their product, bring it to a location for dispensing, and even transport according to qualified applicants.

Understanding the procedure

Supposedly, there are one hundred Florida nurseries that could apply for a license.  However, each medical marijuana business would have to provide proof that they could sustain themselves financially for at least two years.  By law, growers must post a $5 million bond, and be able to afford testing equipment that will cost about $1 million. For now, the exact process of testing medical marijuana oils, paste, and vapor is undecided; ultimately, the substances must adhere to adequate THC and CBD guidelines.

Debate remains for growers

According to the Palm Beach Post, Joel Stanley of Colorado initially sparked interest among growers in Florida with his success from growing non-euphoric medical marijuana, commonly called, “Charlotte’s Web.”  In addition to an interest in its profitability, the moral benefit for growers of this particular strain of medical marijuana is found in how it helps to drastically alleviate epilepsy seizures in children. “I do wish the best rule would come forward that would allow the department to pick the cream of the crop because that’s what the people that are waiting on this deserve,”  Stanley explained.  “I know a lot of people who did this years before anyone knew about it or even thought there was any money it … if you think you’re the cream of the crop … consider putting your cream of the crop because on the line because it’s a really amazing thing you will get to do. It’s a lot better than growing tomatoes or hydrangeas or whatever the hell you’re growing.”

Florida Bill for Recreational Marijuana

New regulations regarding medical marijuana may not take effect in Florida until April 2015 at the earliest, if at all.  However, Senator Dwight Bullard is pushing forward with another bill for recreational marijuana.  According to the Palm Beach Post, the proposal of the 50-page Senate Bill 1176 would permit individuals that are 21 years of age and older to use, obtain, or transport 2.5 ounces of marijuana, as well as grow a maximum of six crops of the plant.  Last year, there was another attempt at a similar bill, called HB 683, which failed to pass.  It was supposed to permit specific patients and caretakers to buy and use medical marijuana.  SB1176 which is pushing to get recreational marijuana legalized in the state of Florida, may not even reach legislation.  The bill isn’t likely to pass if there isn’t support from the state.  Either way, residents of Florida are encouraged to voice their opinions on the matter by calling the District Office in Cutler Bay.
